29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures. a. On or about August 5, 2011, at the above addressed jobsite, employees conducting culvert installation operations undermined the pavement by three (3') seven (7") inches, thereby exposing employees to the hazards associated with a street collapse.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. a. On or about August 5, 2011, at the above addressed jobsite, employees were not provided with safe means of access to the top of a culvert three (3') feet below. Employees were thereby exposed to the hazards associated with falls.
