29 CFR 1926.451(g)(4)(iii):     When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalentstructural members are used, they shall be installed between the top edge of the guardrail system and the scaffold platform.    (a) Employer did not ensure that a mid-rail was being used when using a scissors lift. The scissors lift was used to gain access to the roof in order to conduct roofing work. Employees were exposed to a fall hazard.

29 CFR 1926.1051(a):     A stairway or ladder shall be provided at all personnel points of access where there is a break inelevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.    (a) Employer did not ensure there was a stairway or ladder provided for access to and from a scissors lift. Employees were using the scissors lift to gain access to the roof of a multi-family residential building in order to conduct roofing work. Employees were exposed to a fall hazard.

29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from fallingor flying objects, or from electrical shock and burns, shall be protected by protective helmets.    (a) Employer did not ensure that employees were using head protection when conducting roofing work under equipment and material. Employees were exposed to a struck-by hazard.       Gabriel Lopez Alvarez (Three Amigos, DBA) was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 313720112, citation number 01, item number 001 and was affirmed as a final order on July 26, 2010, with respect to a workplace location at 6670 Lonewood, Colorado Springs, CO 80925.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    (a) Employer did not ensure that fall protection was being used when conducting roofing work on the main roof and entry-way roof. Employees were exposed to a fall hazard.
