29 CFR 1910.178(l)(4)(ii)(B): The employer did not ensure that an operator that had been involved in an accident or near-miss incident received refresher training and evaluation to ensure they had the knowledge and skills needed to operate the powered industrial truck safely; a) On October 23, 2011, a powered industrial truck operator was not retrained after being involved in an accident where an employee was struck by the bin filler resulting in a broken foot/ankle resulting in days away from work.
