29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. Barry Callebaut USA, LLC had employees exposed to fall hazards without fall protection while carrying out work duties on a daily basis. These fall exposures included the following: a. Tanker Trailer (Loading/Unloading) 10.5 ft. and b. Finished Goods Horizontal Storage Tanks 8 ft., 9 in.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. Barry Callebaut USA, LLC had employees exposed to bodily injury from the use of powered industrial trucks, forklifts, without conducting a daily forklift inspection, each shift.
