29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. a. On or about September 28, 2011, at the above addressed jobsite, employees were permitted to work in and near the traveled way of south bound Kedzie Avenue without providing signage indicating how motor vehicle traffic can move through the temporary traffic control zone as required by MUTCD Section 6G.03 THE MADDEN SEWER & DRAINAGE, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.200(G)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311374904, CITATION NUMBER 1, ITEM NUMBER 3 AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 20, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 1550 NORTH DAMEN AVE, CHCIAGO, IL 60622.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a. On or about September 28, 2011, at the above addressed jobsite, an inspection of the excavation was not performed by a competent person, thereby exposing an employee to the hazards associated with cave-ins and egress. THE MADDEN SEWER & DRAINAGE, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.200(G)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311374904, CITATION NUMBER 1, ITEM NUMBER 1B AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 20, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 1550 NORTH DAMEN AVE, CHCIAGO, IL 60622.
