29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:         (a)    Roggen Farmer's Elevator Assn., at 555 E. Colfax Ave., Bennett, CO 80102:  The employer did not provide a                medical evaluation to determine the employee's ability to use respirators, before the employees used the                respirators. The employee used a 3M half-face, negative pressure, air-purifying respirator or a Moldex 2300 N95               tight fitting facepiece when cleaning the basement and boot pits. This hazard exposed the employee               to health hazards of using a respirator unsafely.

29 CFR 1910.134(h)(2)(i):  Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals, and they were not packed or stored to prevent deformation of the facepiece and exhalation valve:        (a)    Roggen Farmer's Elevator Assn., at 555 E. Colfax Ave., Bennett, CO 80102:  The 3M half-face negative pressure              air-purifying respirator was not stored to protect it from damage, contamination and dust in that it was not                stored properly and was dusty.  This condition exposed the employee to a potentially damaged and dirty               respirator.

29 CFR 1910.134(h)(1):  The employer did not ensure that respirators were cleaned and disinfected using the procedures in Appendix B-2 of this section, according to the intervals as specified in subparagraphs (h)(1)(i) through (h)(1)(iv), or procedures recommended by the respirator manufacturer, provided that such procedures were of equivalent effectiveness:         (a)    Roggen Farmer's Elevator Assn., at 555 E. Colfax Ave., Bennett, CO 80102: the employer did not ensure that               the 3M half-face negative pressure, air-purifying respirator used when cleaning the basement and boot               pits was regularly cleaned and disinfected.  This condition exposed the employee to using a respirator                contaminated with dust.

29 CFR 1910.134(d)(3)(iv)[B]:  For protection against particulates, the employer did not provide an air-purifying respirator equipped with a filter certified by NIOSH under 30 CFR part 11 as a high efficiency particulate air (HEPA) filter, or an air-purifying respirator equipped with a filter certified for particulates by NIOSH under 42 CFR part 84:         (a)    Roggen Farmer's Elevator Assn., at 555 E. Colfax Ave., Bennett, CO 80102:  The employer did not select the               appropriate respirator in that the employee was provided a 3M half-face, negative pressure, air-purifying               respirator with an organic vapor filter for use when cleaning the basement and boot pits.  The contaminate in                   the areas consisted of grain dust.  This condition exposed the employee to health hazards of using a respirator               unsafely.

29 CFR 1910.272(j)(2)(ii): The employer did not immediately remove any fugitive grain dust accumulations whenever they exceeded 1/8 inch (.32cm) at priority housekeeping areas, pursuant to the housekeeping program for grain elevators:        (a)    Roggen Farmer's Elevator Assn., at 555 E. Colfax Ave., Bennette, CO 80102:  The employer did not ensure any              fugitive dust accumulations were removed from priority housekeeping areas in that dust had accumulated in the              upper areas of the basement and boot pit of the concrete silo side of the facility.  Those areas had been               identified as priority housekeeping areas by the employer.
