29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA. On or about October, 31, 2011, Barone Contracting, LLC did not conform to Section 6G.03 of the Manual on Uniform Traffic Control Devices, Millenium Edition when employees were permitted to work in an near the traveled way of Orchard Drive without erecting signage to warn approaching road users of construction work. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) or 29 CFR 1926.652(b). On or about October 31, 2011, Barone Contracting, LLC employees worked in an excavation without cave-in protection while making a catch basin connection to an out flow plastic pipe at a depth of no less than 5.8 feet. Barone Contracting, L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 313621922, citation number 1, item number 3, and was affirmed as a final order on August 19, 2009, with respect to a workplace located at 2130 Nimitz, Des Plains, Illinois. Barone Contracting, L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 313935785, citation number 1, item number 2, and was affirmed as a final order on July 8, 2010, with respect to a workplace located at 15435 Waveryly Ave., Oak Forest, Illinois. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
