The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): (a) Excavation site located at W4401 Hwy 29, Spring Valley, WI; On or about November 3, 2011, employees in an excavation were not protected from cave-ins by a protective system while installing and connecting waterlines in a trench that was approximately 220 feet long, more than 6 feet deep and had near-vertical walls. An employee was fatally injured when a cave-in occurred at the northwest end of the trench.
