29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) At the establishment, the Raymond Orderpicker forklift truck, serial #ESAI-99-GC23807, had not been taken out of service when the truck's pallet clamp was identified to be malfunctioning exposing employees to a struck-by hazard. b) At the establishment, the Prime Mover forklift truck had not been taken out of service when the forklift's brakes were identified as inoperable exposing employees to a struck-by hazard. The brakes had been inoperable for 3 to 4 months.
