29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On November 4, 2011, an employee was subject to severe fall hazards when he was working at a height of approximately 12 feet standing on a pallet tied to the mast of a florklift with no form of fall protection. The employee was elevated on the forklift rehanging Christmas light clips at a height of approximately 12 feet, with hard surface concrete and asphalt beneath.
