29 CFR 1910.178(l)(3)(i)(A): Operating instructions, warnings, and precautions for the types of truck the operator will be authorized to operate; (a) DECA Warehouse: On or about November 1, 2011 and times prior thereto, employees had not been trained in the use and inspection of fall protection that was required when using the Clark powered industrial vehicle. This exposed employees to fall hazards from not being trained on how to wear and inspect the equipment. (b) DECA Warehouse: On or about November 1, 2011 and times prior thereto, employees were allowed to step off the working platform of the Clark powered industrial vehicle onto a wooden pallet attached to the forks of the vehicle. This exposed employees to fall hazard from swinging back into the vehicle.

29 CFR 1910.334(a)(3)(ii): Attachment plugs and receptacles may not be connected or altered in a manner which would prevent proper continuity of the equipment grounding conductor at the point where plugs are attached to receptacles. Additionally, these devices may not be altered to allow the grounding pole of a plug to be inserted into slots intended for connection to the current-carrying conductors. DECA Warehouse: On or about November 1, 2011 and times prior thereto, employees used 2 extension cord sets and a floor scrubbing machine with the ground pins removed. This exposed employees to electric shock hazards from using ungrounded equipment.
