OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) On or about November 4, 2011, employees were exposed to struck-by hazards from vehicular traffic while installing lights on trees in a median of an urban multi-lane street. Employees were working in and crossing live lanes of traffic with no traffic control devices or signs in place to protect them and alert motorists to the work. A traffic control plan also had not been developed and followed nor had employees been trained by the employer on hazards associated with working in traffic and how to prevent these hazards. Abatement Note: One feasible and acceptable method of abatement is to follow the Manual on Uniform Traffic Control Devices (MUTCD), Section 6 with regard to development of a traffic control plan, installation of traffic control devices and use of advance warning signs.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On or about November 4, 2011, employees were exposed to struck-by hazards while working in and crossing live lanes of traffic without the use of high visibility safety apparel to alert motorists to their presence. Abatement Note: One feasible and acceptable method of abatement is to follow ANSI/ISEA 107 - 2010 American National Standard for High Visibility Safety Apparel and Headwear Devices with regard to protective apparel selection.
