29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: On or about November 8, 2010, during construction activities including but not limited to roofing activities the employer did not ensure employees were protected from eye hazards by ensuring eye protection was available and worn during nailing and weatherproofing material removal.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about November 8, 2011, during construction activities including but not limited to roofing activities the employer did not ensure employees were protected from fall hazards approximately 19 feet by ensuring a fall protection system system/device was being used.
