29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. When guardrail systems, [or chain, gate, or guardrail] or portions thereof, are removed to facilitate the hoisting operation (e.g., during landing of materials), and an employee(s) must lean through the access opening or out over the edge of the access opening (to receive or guide equipment and materials, for example), the employee(s) was not protected from fall hazards by a personal fall arrest system. (a) Closet Design, LLC on or about November 08, 2011 at the address of 39 South Erie St. Toledo, OH: The employer failed to ensure an employee was protected from a fall while spotting the crane's load from a sixth floor hoisting/landing platform. The employee was observing the location of the crane's load through the unguarded sixth story window during which, he was exposed to an approximate 60ft fall to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) Closet Design, LLC on or about November 08, 2011 at the address of 39 South Erie St. Toledo, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while spotting for the crane's load through an unguarded hoisting/landing area approximately 60ft above the ground below.
