29 CFR 1926.501(b)(1) Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) KJM Tile and Stone, LLC on or about November 08, 2011, at the address of 39 South Erie St. Toledo, OH: The employer failed to ensure an employee was protected from a fall while walking across the sixth floor hoisting/landing platform. In the process of attaining materials, the employee was required to walk across the raised platform adjacent to an unguarded sixth story window opening. The employee was exposed to an approximate 60ft fall to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) KJM Tile and Stone, LLC on or about November 08, 2011, at the address of 39 South Erie St. Toledo, OH: The employer did not ensure that employees had been trained to identify the need and appropriate use of fall protection systems such as but not limited to the use of personal fall arrest systems or alternative measures while working near unprotected sides and edges.
