29 CFR 1926.503(c):  The employer did not retrain affected employees  who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:    (a)  Vaquera's Construccion at 1355 Franklin St, Denver, CO 80218:  On and before November 4, 2011, the exposing employer did not ensure that employees demonstrated adequate understanding and skill as required by paragraph (a) of this section.  Three employees who had completed a re-roofing job were installing OSB in certain locations as requested by the homeowner in an effort to control a bird roosting problem.  This was a 7-in-12 pitch roof on a two-story residential home.  Three employees were not using fall protection systems while conducting this work on the roof. This condition exposed employees to a fall hazard of approximately 28 feet.    Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee has not retained the requisite understanding or skill.
