29 CFR 1926.300(a): Condition of tools. All hand and power tools and similar equipment, whether furnished by the employer or the employee, shall be maintained in a safe condition.    a.  On or about November 10, 2011, at the above addressed jobsite, two skill saw were observed to have splices in the cord, thereby exposing employees to the hazards associated with power tools.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    a.  On or about November 10, 2011, at the above addressed jobsite, employees performing sheething operations on a  roof twenty-one (21') feet eight (8") inches above the ground were not protected from falls, thereby exposing employees to fall hazards.    b. On or about November 10, 2011, at the above addressed jobsite, an employee performing carpentry operations from rafters eleven (11') feet nine (9') inches above the ground was not protected from falls, thereby exposing the employee to fall hazards.    c.  On or about November 10, 2011, at the above addressed jobsite, employees performing carpentry operations on the second floor were exposed to a fall of sixteen (16') feet above the ground created by the presence of window openings.      d.  On or about November 10, 2011, at the above addressed jobsite, employees performing carpentry operations on the second floor loft were exposed to falls of nine (9') feet eleven (11") inches above the ground due to lack of fall protection.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with at least one handrail.    a.  On or about November 10, 2011, at the above addressed jobsite, the stairway to the second floor was not provided with handrails, thereby exposing employees to fall hazards.
