29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmosphere, or other hazardous conditions: (a) On or about October 29, 2011, Bridger Pipeline Company LLC dba Belle Fourche Pipeline Company LLC, as controlling employer, did not ensure that Loenbro Pipeline Company, a subcontractor, protected their employees from injury while working in a trench in that a competent person did not perform a manual inspection of the trench prior to start of work and as needed through the day.
