29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmosphere, or other hazardous conditions: (a) On or about October 25, 2011, employees were exposed to injury while working in a trench in that a competent person did not perform a manual inspection of the trench prior to start of work and as needed throughout the day.

29 CFR 1926.652(a)(1): Each employee in an excavation more than 5 feet in depth was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about October 25, 2011, employees were exposed to injury while working in an unsupported trench of approximately 9 feet 4 tenths in depth. North Star Energy & Construction LLC dba 3-Way, Inc., was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection 314897042, Citation Number 1, Item 3, and affirmed as a final order on 9/6/2011, with respect to a workplace located at Hwy 22 North and 18th Street NW, Mandaree, ND 58757.
