29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.     On or about November 15, 2011 employees were using a combination of tubular welded and walk through type scaffolding to access the roof to perform masonry work. The scaffold did not have safe access and employees were climbing the frame of the scaffold exposing the employees to a fall hazard of greater than 25 feet.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      On or about November 15, 2011 employees were on a roof preping for and performing masonry restoration work without fall protection exposing the employees to a fall hazard of greater than 25 feet.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR 1910.1200(e)(1):     Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met.    The employer did not develop and implement a written hazard communication program for employees exposed to hazardous chemicals in their daily activity. A hazard communication program should include, but not be limited to:         1. The purpose and scope of the program.         2. A list of hazardous chemicals being used at the facility.         3. Material Safety Data Sheets for all the hazardous chemicals used at the facility         4. Labeling and other forms of warnings.         5. Training agenda and requirements.    Abatement certification is required for this item in accordance with the requirements of 29CFR1903.19(c).
