Section (5)(a)(1) of the Occupational Safety and Health Act:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:    (a)  Onchuck Construction, Inc. at 3407 11th Street SE, Minot, ND 58702:  On or about October 24, 2011, the employer allowed an employee to frame trusses by standing on the elevated forks of a rough terrain forklift without the use of a platform.  Condition exposed employee to fall hazards of up to 8'.    Among other methods, one feasible and acceptable abatement method is stated in American National Standards Institute B56.6 - 2005, Safety Standard for Rough Terrain Forklift Trucks, Section 5.15.1(a):  "A rough terrain forklift shall not be used to lift people unless there is no other practical option.  If a rough terrain forklift must be used to lift people, the following precautions for the protection of personnel shall be taken:  (a) provide a personnel platform which complies with the design requirements listed in Part III of this standard; ".
