29 CFR 1926.451(c)(2)(v):  Forklifts were used to support scaffold platforms while the entire platform was not attached to the fork and the forklift was moved horizontally while the platform was occupied:    (a)  River Crest Homes, Inc. at 2700 Heritage Court, Minot, ND 58701:  On or about October 25, 2011, the employer operated an Ingersol Rand rough terrain forklift, model VR-642B, to elevate two employees on a platform,where the forklift was moved horizontally while the elevated platform was occupied.   Condition exposed employees to fall hazards of up to 13' 5".

29 CFR 1926.451(g)(1)(vii):  Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    (a)  River Crest Homes, Inc. at 2700 Heritage Court, Minot, ND 58701:  On or about October 25, 2011, the employer operated an Ingersol Rand rough terrain forklift, model VR-642B, to elevate two employees on an open-front metal platform, and the employees were not protected from falling by a guardrail system or a personal fall arrest system.  Condition exposed employees to fall hazards of up to 13' 5".

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:    (a)  River Crest Homes, Inc. at 2700 Heritage Court, Minot, ND 58701:  On or about October 25, 2011, the employer did not ensure that employees were using fall protection in the following instances:    1.  Employees were working on the roof installing Tyvek paper under the upper eaves without the use of fall protection, with a fall hazard of 13'5" measured from ground to upper eave; and    2.  Employees were framing the interior of the upper floor, with wall openings for two 4' wide windows that were 36" above the floor, with a fall hazard of 10'.    Condition exposed employees to fall hazards of up to approximately 13' 5".

Condition exposed employees to fall hazards of up to approximately 13' 5" and to the hazard of being struck by materials and equipment.
