29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a)  Vasquez, Walter A dba 3 Construction at 926 Spring Creek Drive, Williston, ND 58801:  On or before October 28, 2011, the employer did not ensure that employees were trained and evaluated to operate the Terex TH844C rough terrain forklift.  Condition exposed employees to struck-by hazards.    Abatement Note:  1926.602(d), powered industrial truck operator training, provides that the requirements applicable to construction work under this paragraph are identical to those set forth in 1910.178(l) of this chapter.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:    (a)  Vasquez, Walter A dba 3 Construction at 926 Spring Creek Drive, Williston, ND 58801:  On or before October 28, 2011, the employer did not ensure that employees were using fall protection when framing this house in the following instances:    1.  An open stairway hole measuring 12' x 42" was not guarded or covered, with a 9'4" fall hazard to the basement;    2.  Two open elevator holes, each measuring about 8' x 41", were not guarded or covered, each with a 9'4" fall hazard to the basement;     3.  Four window well holes, each measuring 45" x 64", were not covered, each with a 6'3" fall hazard to the basement; and    4.  One elevated plank was not secured to prevent it from sliding off its support bracket, with a fall hazard of 9'2".     Conditions exposed employees to fall hazards of up to 9'4".

29 CFR 1926.403(b)(2):  Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:      (a)  Vasquez, Walter A dba 3 Construction at 926 Spring Creek Drive, Williston, ND 58801:  On or before October 28, 2011, the employer was using a metal 4-plex electrical outlet box on the ground of the interior of the house to power 110-volt hand tools, and this metal outlet box was not certified for such use.   A ground-fault circuit interrupter was in use.  Condition exposed employees to electrical shock hazards.

29 CFR 1926.404(f)(6): The path-to-ground from circuits, equipment, or enclosures was not permanent and continuous:    (a)  Vasquez, Walter A dba 3 Construction at 926 Spring Creek Drive, Williston, ND 58801:  On or before October 28, 2011, the employer was using a yellow extension cord with an open ground to power a 110-volt Skilsaw, model HD77M, serial number 988 34623.  The saw was not double insulated, but was used with a ground-fault circuit interrupter, in the interior of the house.  Condition exposed employees to electrical shock hazards.
