29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:    (a)  Tofte Brothers Construction, Inc. at 926 Spring Creek Drive, Williston, ND 58801:  On or before October 28, 2011, the employer did not ensure that framing company employees, with exposure to fall hazards of approximately 9 feet, were using fall protection when framing this house in the following instances:    1.  An open stairway hole measuring 12' x 42" was not guarded or covered, with a 9'4" fall hazard to the basement;    2.  Two open elevator holes were not guarded or covered, each measuring about 8' x 41" with a 9'4" fall hazard to the basement;     3.  Four window well holes were not covered, each measuring 45" x 64" with a 6'3" fall hazard to the basement; and    4.  One elevated plank was not secured to prevent it from sliding off its support bracket, with a fall hazard of 9'2".
