29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:    a) Hanem Construction at the worksite located at 1422 S. Lallendorf Rd. in Oregon, Ohio: On or about November 18, 2011, an employee performing roofing operations on a residential structure was not adequately protected from falls of approximately eight feet in that the attachment point of the body harness was located on the wearers side and not in the center of the wearers back.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.503(a)(2)(iii):  The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.    a) Hanem Construction worksite located at 1422 S. Lallendorf Rd. in Oregon, Ohio: On or about November 18, 2011, the employer did not train employees in the proper use and operation of personal fall arrest systems.  Employee(s) performing roofing operations were exposed to an approximate eight foot fall hazard in that the harness of a personal fall arrest system was not worn properly.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:    a) Hanem Construction worksite located at 1422 S. Lallendorf Rd. in Oregon, Ohio: On or about November 18, 2011, a portable step ladder was not used in a way in which it was designed, exposing employees to a fall hazard of up to approximately eight feet.  A step ladder was used to access the roof of a residential structure by using it as a straight ladder rather than using it as it was intended, in an open position with the metal spreader locking device in place.     No additional abatement information is needed for this item.
