29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    a) Commercial Glazing Systems, Inc. on or about November 18, 2011, at the worksite located at 215 E. Front St. in Perrysburg, OH: The employer did not assure that a personal fall arrest system was used by employee(s) performing window finishing operations from a Genie (#R56317) aerial lift.  An employee performing work in this condition was exposed to an approximate 15 ft. fall hazard.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) Commercial Glazing Systems, Inc. on or about November 18, 2011, at the worksite located at 215 E. Front St. in Perrysburg, OH: An employee performing window finishing operations from a flat roof was exposed to an approximate 15 ft. fall hazard.  The employer did not assure that unprotected sides were guarded to prevent falls.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
