(subcontractor) were protected from injury in that, spoils were not set back at least 2 feet from the edge of the foundation excavation or otherwise retained to prevent spolis from falling into the excavation where employees were working.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On or about November 18, 2011 and at times prior, Century Communities, LLC as controlling employer, did not ensure that employees of J & C Foundations, Inc. (subcontractor) were protected from injury in that, they were working next to and near unprotected, vertical foundation excavation walls and placing forms against these walls. The soil showed evidence of fissures, cracking and deterioration.

(subcontractor).
