29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Majestic Roofing, LLP @ 3746 Higgins St., Loveland, CO 80538: On and before November 14th, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees conducting roofing operations were permitted to work in areas where fall hazards existed. The condition exposed to a fall hazard of approximately 10 feet.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Majestic Roofing, LLP was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA Inspection Number 313413478 , Citation Number 1, Item 1 issued on September 9th, 2009, and became Final Order on September 30th, 2009, with respect to a workplace located at 320 Sandstone Dr., Johnstown, CO 80534.
