OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a. Back room - On or about November 20, 2011, an employee of Nandorf, Inc. dba Unique Thrift stores, experienced a fall of approximately 96 inches while accessing the sixth step (top step) of a Louisville fiberglass stepladder, Model No. FS1506.  The manufacturer of the step ladder, Louisville, had warning signs prohibiting employees from working above the fourth step of the step ladder. 29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides:    a. Back Room - On or about November 28, 2011, employees working on an open sided platform 8 feet high, were not provided with an adequate standard railing.  Employees were thereby exposed to hazards associated with falls.

Back Room - On or about November 28, 2011, employees were required to use a portable step ladder to access an open sided platform 8 feet high.  Fixed stairs were not provided where operations necessitated regular travel between levels.  Employees were thereby exposed to hazards associated with falls.

29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route.     a. Back room - On or about November 28, 2011, in the facility, the exit routes were obstructed by clothes and carts.  Employees working in the facility were thereby exposed to the hazards associated with blocked exit routes. These hazards include, but are not limited to, trips, falls, burns and smoke inhalation.    Nandorf, Inc. dba Unique Thrift Store, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.37(a)(3), which was contained in OSHA inspection number 313937120, citation 01, item 1, and was affirmed as a final order on October 14, 2010, with respect to a workplace located at 3000 S. Halsted, Chicago, IL 60608.

29 CFR 1910.212(a)(3)(ii):  Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    a. Back room - On or about November 28, 2010, Employees were required to use a garbage compactor on a daily basis.  The garbage compactor was not guarded in that cycling of the machine was allowed while the door remained in the open position, thereby exposing employees to injuries associated with unguarded points of operation.

29 CFR 1910.22(d)(1): In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official shall be marked on plates of approved design which shall be supplied and securely affixed by the owner of the building, or his duly authorized agent, in a conspicuous place in each space to which they relate. Such plates shall not be removed or defaced but, if lost, removed, or defaced, shall be replaced by the owner or his agent.    a. Back room - On or about November 28, 2011, places of storage, such as the loft, where boxes were stored above working personnel, was not properly identified with a weight load limit placard.  Employees were there by exposed to hazards associated with storage load capacities.
