29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet above the lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) Herzog Roofing, Inc. at 1400 31st Avenue South, Minot, ND 58701: On or about October 26, 2011, the employer did not ensure that an employee was protected from falling when working on an elevated scaffold platform 10.5' high installing metal fascia. The guardrail system included cross bracing on the front side but did not include supplemental horizontal bracing. Condition exposed this employee to fall hazards of up to 10.5' from ground to the scaffold platform.
