29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) On or about November 22, 2011, Re/Max, as the controlling employer, did not ensure that Bob Popp Building Services, a sub-contractor, protected their employees from falls in excess of 10 feet in the central area of the roof (central air vents), and falls in excess of 20 feet on the east and west ends of the roof (cooling towers area) while working or walking near the openings without fall protection. b) On or about November 22, 2011, the employer did not ensure that employees were protected from falls in excess of 10 feet in the central area of the roof (central air vents), and falls in excess of 20 feet on the east and west ends of the roof (cooling towers area) while working or walking near the openings without fall protection.
