29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees:    (a)  Bobkat, Inc. dba Greater Denver Mr. Rooter at 6561 Ash Ct, Commerce City, CO 80022:  On and before November 28, 2011, the exposing employer did not ensure that each employee removing a damaged sewer line inside the trench located in the street was provided with a safe means of egress, in that a stairway, ladder, ramp or other safe means of egress was not installed in the trench. The trench measured approximately 9.5 feet in depth. This condition exposed the employee to a crushing hazard by excavation wall cave-in.

29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)  Bobkat, Inc. dba Greater Denver Mr. Rooter at 6561 Ash Ct, Commerce City, CO 80022:  On and before November 28, 2011, the exposing employer did not ensure the spoils pile was 2 feet from the edge of the trench. The trench was approximately 30 feet in length, 2.5 feet wide, and ranged from 8.5 to 9.5 feet in depth. This condition exposed the employees to the hazard of the materials falling into the trench or causing the trench to collapse.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)  Bobkat, Inc. dba Greater Denver Mr. Rooter at 6561 Ash Ct, Commerce City, CO 80022:  On and before November 28, 2011, the exposing employer did not ensure that each employee removing a damaged sewer line inside a trench that ranged from 8.5 to 9.5 feet in depth was protected from cave-in. An employee worked at the bottom of the trench in the front yard without using a complete protective system. One shield system was installed at the bottom of the trench for protection; however, the vertical panels measured 5 feet in height, thus not providing complete protection. This condition exposed the employee to a crushing hazard by excavation wall cave-in.    (b)  Bobkat, Inc. dba Greater Denver Mr. Rooter at 6561 Ash Ct, Commerce City, CO 80022:  On and before November 28, 2011, the exposing employer did not ensure that each employee removing a damaged sewer line inside a trench that measured approximately 9.5 feet in depth was protected from cave-in. An employee worked at the bottom of the trench in the street without using a complete protective system. One shield system was installed at the top of the trench for protection; however, the vertical panels measured 5 feet in height, thus not providing complete protection. A distance of 6.5 feet was measured from the bottom of the shield system to the bottom of the trench. This condition exposed the employee to a crushing hazard by excavation wall cave-in.    (c)  Bobkat, Inc. dba Greater Denver Mr. Rooter at 6561 Ash Ct, Commerce City, CO 80022:  On and before November 28, 2011, the exposing employer did not ensure that each employee removing a damaged sewer line inside a trench that measured approximately 9.5 feet in depth was protected from cave-in. An employee worked at the bottom of the trench in the street without using a complete protective system. A shield system with s sides was used, thus not providing protection on the other two sides. The trench opening measured 6 feet by 3 feet. This condition exposed the employee to a crushing hazard by excavation wall cave-in.    Bobkat, Inc. dba Greater Denver Mr. Rooter was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.652(a)(1) which was contained in OSHA Inspection Number 310464060, Citation Number 1, Item 1a issued on January 31, 2007, and became Final Order on March 14, 2007, with respect to a workplace located at 891 S Holly, Denver, CO 80246.
