29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a)  Future Builders, Inc. at 2717 Fifth Street NW, Minot, ND 58703:  On or about October 25, 2011, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns.  Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it was infeasible or that it created a greater hazard to use these systems, and did not develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a)  Future Builders, Inc. at 2717 Fifth Street NW, Minot, ND 58703:  On or about October 25, 2011, the employer did not ensure that employees were using fall protection in the following instances:    1.  An employee was framing by standing on the exterior top plate of Building D, with a fall hazard of approximately 10';    2.  Three employees were sheathing the deck of Building D and were not using personal fall arrest systems or a fall monitoring system, with a fall hazard of approximately 12';    3.  Two employees were siding Building C by working on its patios and were not using personal fall arrest systems, guardrails, or fall monitoring, with fall hazards of approximately 12'; and    4.  Employees were framing Building C, which contained 9 apartment units, and each unit contained unguarded wall openings for the patio door measuring 6' wide, and for two windows each measuring 35 1/2" above the floor and up to 5' wide, with fall hazards of approximately 12'.    Conditions exposed employees to fall hazards of up to approximately 12'.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a)  Future Builders, Inc. at 2717 Fifth Street NW, Minot, ND 58703:  On or about October 25, 2011, the employer did not ensure that each forklift operator was trained and evaluated to safely operate the Gehl RS5-34, Gehl 553, and the Mustang rough terrain forklifts used on-site.  Condition exposed employees to the hazard of being struck-by materials and equipment.      Abatement note: 1926.602(d) provides, under powered industrial truck operator training, that the requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.405(a)(2)(ii)(I):  Flexible cords and cables used for temporary wiring were not protected from damage:    (a)  Future Builders, Inc. at 2717 Fifth Streeet NW, Minot, ND 58703:  On or about October 25, 2011, the employer did not ensure that two extension cords, one yellow and one black, were protected from damage when placed across the driveway and run over by forklifts.  The receptacle on the yellow extension cord was cracked.  The cords were used with 120-volt portable tools.  Conditions exposed employees to potential electrical shock hazards.
