29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):    (a)  Timberland, Inc. at 4201 Fourth Avenue West, Williston, ND 58801:  On or before October 30, 2011, the employer allowed employees to use a Werner 20-foot aluminum extension ladder, model D1320-2, at a 50 degree angle, and did not ensure it was set up at a 4-to-1 angle of the length of the ladder (hypotenuse) to horizontal.  Condition exposed employees to a fall hazard of approximately 19'.  (There was a 5' hole in the ground near the ladder and steel column.)

29 CFR 1926.760(a)(1):   Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:    (a)  Timberland, Inc. at 4201 Fourth Avenue West, Williston, ND 58801:  On or before October 30, 2011, the employer did not ensure that an employee was protected from falling when walking and working on the top exterior horizontal I-Beam (top plate) and when standing on and working from the first unsecured piece of metal roof decking, for the motel entryway.  Condition exposed this employee to fall hazards of up to 18' 9".
