29 CFR 1910.120(q)(1):     The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations:  (a) In the Chemical Room of the West Building at Fair Oaks Farms, on or around November 29, 2011, a foreman responded to an uncontrolled release of hazardous decomposition products, which occurred after inadvertent addition of alkaline chlorinated sanitation chemical to a drum containing acid.  However, the employer had not developed and implemented an emergency respose plan prior to commencing such emergency response operations.

29 CFR 1910.120(q)(6):     The employer did not provide training in accordance with 29 CFR 1910.120(q)(6)(i) through (q)(6)(v) for employees who participated in or were expected to participate in emergency response:    (a) On or around November 29, 2011, at the West Building of Fair Oaks Farms, following an incident in which an alkaline chlorinated cleaning solution was inadvertently mixed and reacted with acid resulting in an uncontrolled release of hazardous decomposition products, a foreman responded in an effort to mitigate the condition.  However, appropriate emergency response training had not been provided to this worker

29 CFR 1910.1200(f)(5)(i):     The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:    (a) In the Chemical Room of the West Building of Fair Oaks Farms, a partially full container of ZEP 4089, Concentrated Chlorinated Foaming Highly Alkaline Cleaner,was not labeled or tagged with its identity.  This substance could cause  damage to eyes, may burn skin, and could cause respiratory tract damage.  If inadvertently combined with acid, exposure to hazardous decomposition products, including hydrogen chloride gas and phosgene gas, could occur.

29 CFR 1910.38(c)(2):     29 CFR 1910.38(c)(3): An emergency action plant did not include procedures to be followed by employees who remain to operate critical plan operations before they evacuate:    (a) According to page 20 of the blue booklet, in the event of a major fire all workers were to evacuate, except for the CSL plant manager and CSL operations manager.  However, the tasks for these managers to perform prior to evacuating were not described.
