29 CFR 1926.451(b)(1)(i):  Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:    (a)  Black Gold Oil Field Services LLC, Williston, ND 58801:  On or about November 1, 2011, the employer constructed horizontal supports about 3' long for a scaffold platform, where one 2 x 8 was on the platform for use, and the platform was not fully planked.  Employees used this platform, about 20' long, to access the roof.  Condition exposed employees to fall hazards of up to approximately 24 feet.

29 CFR 1926.451(b)(2):  Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide:    (a)  Black Gold Oil Field Services LLC, Williston, ND 58801:  On or about November 1, 2011, the employer allowed employees to use an 8" wide scaffold platform, about 20' long, to access the roof, and did not ensure that the platform was at least 18" wide.  Condition exposed employees to fall hazards of up to approximately 24 feet.

29 CFR 1926.451(f)(7):  Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:      (a)  Black Gold Oil Field Services LLC, Williston, ND 58801:  On or about November 1, 2011, the employer did not ensure that scaffolds were erected under the supervision of a competent person in two instances:    1.  The pump jack scaffold was not erected with appropriate guardrails; and    2.  The platform inside the building used to access the roof was not erected with appropriate guardrails and was not fully planked.    Condition exposed employees to fall hazards of up to approximately 24 feet.

29 CFR 1926.451(g)(1)(vii):  Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    (a)  Black Gold Oil Field Services LLC, Williston, ND 58801:  On or about November 1, 2011, the employer did not ensure that employees were protected from falling when using scaffolds in the following instances:    1.  The employer erected a wood pole pump jack scaffold without adequate guardrails.  The guardrails were connected to the building and did not travel with the platform, so that employees were not protected from falling when raising and lowering the platform.  When the platform was raised and in use, the 2 x 4 wooden top rail could not withstand 200 pounds of force, and the 2 x 4 wooden midrail could not withstand 150 pounds of force, because the vertical supports were 16' apart.  The platform had no end rails; and    2.  The employer allowed employees to use a singular 2 x 8 wood plank scaffold inside the building to access the roof, and the platform had no guardrails.    The employees were not protected from falling by the use of personal fall arrest systems.  Conditions exposed employees to fall hazards of up to approximately 24 feet.    Abatement note:  The spacing of vertical supports for wooden guardrails is defined in 1926 Subpart M Appendix B.

29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:    (a)  Black Gold Oil Field Services LLC, Williston, ND 58801:  On or about November 1, 2011, the employer did not ensure that employees were using fall protection when sheathing the roof with a 3 in 12 pitch.  Condition exposed employees to fall hazards of up to approximately 24 feet.
