1910.23(a)(2): Every ladderway floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so off set that a person cannot walk directly into the opening. On or about November 30, 2011, employees in the facility were required to use ladders which accessed ladderway platforms on Camera Tower(s) 1, 2 and 3 . The ladderway platforms did not have the ladderway floor opening(s) equipped with standard railing(s) and standard toeboard(s) thereby exposing employees to falls of approximately eleven (11') feet and two (2") inches, twenty seven (27') feet and six (6") inches, and twenty five (25') feet and six (6") inches respectively.

29 CFR 1910.27(d)(2)(ii): All landing platforms shall be equipped with standard railings and toeboards, so arranged as to give safe access to the ladder. Platforms shall be not less than 24 inches in width and 30 inches in length. a. On or about November 30, 2011, employees in the facility were required to use ladders which accessed landing platforms on Camera Tower(s) 1, 2 and 3. The landing platforms were not equipped with standard railings and toeboards thereby exposing employees to falls of approximately eleven (11') feet and two (2") inches, twenty seven (27') feet and six (6") inches, and twenty five (25') feet and six (6") inches respectively.

29 CFR 1910.27(d)(5): '"Ladder safety devices." Ladder safety devices may be used on tower, water tank, and chimney ladders over 20 feet in unbroken length in lieu of cage protection. No landing platform is required in these cases. All ladder safety devices such as those that incorporate lifebelts, friction brakes, and sliding attachments shall meet the design requirements of the ladders which they serve. a. On or about November 30, 2011, employees in the facility were required to use fixed ladder(s) to access Camera Tower(s) 1, 2 and 3. The ladders were equipped with ladder safety devices which were not inspected or maintained as required by the manufacturer. The ladder safety devices did not allow for easy vertical movement and had damaged locking carabiners and/or hooks which had not been replaced. The lack of a maintained ladder safety device(s) caused employees to be exposed to falls of approximately six (6) feet to sixty three (63) feet in length.

CFR 1910.132(a): 'Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a. On or about November 30, 2011, employees in the facility were required to access Camera Tower(s) 1, 2 and 3 located approximately forty (40') feet, fifty five (55') and sixty three (63') high respectively . The fixed ladder(s) on Tower(s) 1, 2 and 3 were equipped with ladder safety devices to be used with appropriate personal fall protection, a full body harness, to protect from falls. The employees were provided with full body harnesses to be used with the safety lifting device but were not required to wear the equipment thereby exposing employees to fall hazards.
