Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems: (a) Dave Peterson Framing, Inc. at 2804 15th Avenue NW, Minot, ND 58701: On or about October 25, 2011, the employer did not ensure that employees were using fall protection when framing this house in the following instances: 1. The wall opening for the patio door measured 9.5' wide, with a 10' fall hazard; 2. The wall opening for the 4' wide window facing to the north had the lower window ledge measuring 24" above the floor, with a 10' foot fall hazard; 3. The wall opening for the 4' wide window facing to the south had the lower window ledge measuring 36" above the floor, with a 10' foot fall hazard; 4. The wall opening for the 4' wide window above the loft had the lower window ledge about 24" above the floor, with an estimated fall hazard of 14'; and 5. The loft had an open-sided landing measuring 9'2" above the lower landing. Condition exposed employees to fall hazards of up to 14'.

29 CFR 1926.404(f)(6): The path-to-ground from circuits, equipment, or enclosures was not permanent and continuous: (a) Dave Peterson Framing, Inc. at 2804 15th Avenue NW, Minot, ND 58701: On or about October 25, 2011, the employer allowed the use of two splitters and one extension cord that were missing ground plugs. The cords were used with portable tools, including a 120-volt Bosh circular saw, model RS325, serial number 105005934, that was double-insulated and used with a ground-fault circuit interrupter.
