29 CFR 1910.23(c)(3):  Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board.    a)     On or about November 30, 2011, the employer, Chromatic Technologies Inc. did not ensure employees, who were required to scrape ink from vats while standing on metal platforms adjacent to 3 Roll Mills, were protected from caught-in hazards due to a lack of standard railing on metal platforms.

29 CFR 1910.147(c)(1):  The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      a)     On or about November 30, 2011, the employer, Chromatic Technologies Inc., did not implement a written energy control program so as to protect employees, who are required to clean ink from the 3 Roll Mills, from caught-in hazards due to unexpected energizing, startup or release of stored energy in 3 Roll Mill machines.
