OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about 11/30/11, the employer did not ensure all employees were using all appropriate warning devices while working in the road way. An employee was observed flagging traffic without the proper warning garment. Employee was only wearing a neon green sweatshirt partially covered by bib overalls.

29 CFR 1910.268(j)(4)(iv)(A): Manufacturer's specifications, load ratings and instructions for derrick operation shall be strictly observed: On or about 11/30/11, the employer did not ensure employees were using a telescopic aerial (TEL-29-NEO2) according to manufacturers specifications. Employees were observed moving the vehicle with the TEL-29- NEO2 in the elevated position with an employee in the work platform.
