29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Thiel Brothers Roofing, Inc. at 13593 56th Street NW, Williston, ND 58801: On or about November 2, 2011, the employer did not ensure that employees were protected from falling when installing metal flashing on the parapet walls. Condition exposed employees to fall hazards of up to approximately 30 feet.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: (a) Thiel Brothers Roofing, Inc. at 13593 56th Street NW, Williston, ND 58801: On or about November 2, 2011, the employer was using a metal 4-plex electrical outlet box on the roof to charge two battery packs for portable tools, and this metal outlet box was not certified for such use. In addition, the plug for this metal 4-plex box was also metal and was not labeled or certified for such use. A ground-fault circuit interrupter was in use. Conditions exposed employees to 120-volt electrical shock hazards.
