Condition exposed employee to fall hazards of approximately 8'.

29 CFR 1926.1412(f)(2): The equipment was not inspected by a qualified person at least every 12 months in accordance with paragraphs (f)(2)(i) - (xxi) of this section: (a) Wells Concrete at 6392 114th Street NW, Ray, ND 58849: On or about November 1, 2011, the employer allowed a Kobelco crawler crane, model CK2000 II, serial number 004-02007, to be used for lifting precast wall members weighing up to 50,000 pounds, without an annual inspection within 12 months. The previous inspection was dated May 7, 2010, over 17 months from the date used at this site. Condition exposed employee to the hazard of being struck by falling materials.

29 CFR 1926.501(b)(12): The employer did not ensure that each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems, unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer did not demonstrate that it was infeasible or created a greater hazard to use these systems: (a) Wells Concrete at 6392 114th Street NW, Ray, ND 58849: On or about November 1, 2011, the employer did not ensure that an employee was protected from falling when accessing, traveling and working nearby an open landing on the second level measuring 90' long with a 30' fall hazard. Condition exposed employee to 30' fall hazards. MNDAK Concrete, Inc., the owner of Wells Concrete, was previously cited for a violation of this occupational safety and health standard or its equivalent, 29 CFR 1926.501(b)(12), which was contained in OSHA inspection number 310558705, citation number 1, item number 1, issued January 9, 2007, and became a final order on February 3, 2007, with respect to a workplace located at the University of North Dakota, Grand Forks, ND 58203.
