29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or are likely to be present, which necessitated the use of personal protective equipment (PPE):    (a) C-Ball Venture, LLC, dba Dealers Auto Auction of the Rockies @ 7175 York St., Denver, CO 80229: On and before 12/5/11, the employer did not assess job tasks, specifically in the detail shop, which require the use of personal protective equipment including, but not limited to eye and hand protection. This condition exposed employees to splash and contact hazards.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee who is required by this section to use PPE on knowing when PPE is necessary:    (a) C-Ball Venture, LLC, dba Dealers Auto Auction of the Rockies @ 7175 York St., Denver, CO 80229: On and before 12/5/11, provide training to employees with reference to use of personal protective equipment during the application of chemicals. Employees regularly use Auto Wax Company products, some of which are corrosive specifically, but not limited to, Spoke Wheel Cleaner and Water Spot Remover. This condition contributed to an incident on 11/02/11, when an employee was subject to a splash of Multi-Purpose Solvent in his eye. This condition exposed employees to splash and contact hazards.

29 CFR 1910.151(c)(1): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    (a) C-Ball Venture, LLC, dba Dealers Auto Auction of the Rockies @ 7175 York St., Denver, CO 80229: On and before 12/5/11, the employer provided a Haws Company Model 7501 portable eyewash system for the detail shop. The system was observed to be less than half full as a result of a recent use, due to a chemical splash that occurred on 11/02/11. The employer did not ensure that the emergency eye wash station was capable of providing 15 minutes of continuous water flow. Employees continued to use corrosive Auto Wash Company cleaning products such as, but not limited to, Water Spot Remover and Spoke Wheel Cleaner, both of which had a pH less than 2.
