29 CFR 1910.132(d)(2):  The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person certifying that the evaluation had been performed; the date(s) of the hazard assessment; and, which identified the document as a certification of hazard assessment:    On or about December 6, 2011, in the facility, employees required to perform garment cleaning, including spot cleaning and dry-cleaning activities, were exposed to the hazard of skin and eye contact with hazardous chemicals (e.g. hydrocarbons, acids, bases) necessitating the use of personal protective equipment.  The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use did not present a health hazard to the user:    On or about December 6, 2011, in the facility, employee(s) required to perform dry-cleaning activities, including still cleaning, were provided and used half-mask air-purifying cartridge respirators on a voluntary basis.  The employer did not establish and implement required elements of a written respiratory protection program to ensure the respirator did not present a health hazard to the user.

29 CFR 1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes were not provided within the work area for immediate emergency use:    On or about December 6, 2011, in the facility, employee(s) required to perform garment cleaning operations, including spot cleaning, were exposed to the hazard of eye contact with potentially injurious corrosive materials (e.g. Cal-Strip, NDT Oxy-Bleach, NDT Sour, etc).  Suitable facilities for quick drenching or flushing of the eyes (e.g. emergency eyewash station) were not provided within the work area for immediate emergency use.

The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program describing how the required criteria would be met.
