29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:    (a) Touchstone Granite and Marble, Inc., 6051 N. Washington St. Unit A, Denver, CO, 80216: On or before 12/7/11, compressed air used for cleaning and drying counter tops was not reduced to less than 30 p.s.i.  The pressure of the airline used on the south wall was approximately 90 p.s.i.  This condition exposed employees to an embolism.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    (a) Touchstone Granite and Marble, Inc., 6051 N. Washington St. Unit A, Denver, CO, 80216: On or before 12/7/11, the employer did not ensure that any employee using a respirator voluntarily was provided with the information contained in Appendix D to this section when the employer determined that any voluntary respirator use was permissible.  The employer provided N95 filtering face piece respirators for voluntary use.  This condition exposed the employees to a respiratory hazard.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) Touchstone Granite and Marble, Inc., 6051 N. Washington St. Unit A, Denver, CO, 80216: On or before 12/7/11, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to:    (1) Superior Adhesives polyester  (2) Superior Adhesives epoxy  (3) HanStone Quartz    Abatement note:  The written hazard communication program will also include:    (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:                            (a) Touchstone Granite and Marble, Inc., 6051 N. Washington St. Unit A, Denver, CO, 80216: On or before 12/7/11, the employer did not provide effective information and training to employees regarding the health and safety hazards of the hazardous chemicals in their work area.  This condition exposed employees to a chemical hazard and respirable crystalline silica.    Abatement note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical specific information must always be available through labels and material safety data sheets.
