29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Cross braces shall not be used as a means of access. a. On or about December 7, 2011, at the above addressed jobsite, employees conducting roofing operations from a ladder jack scaffold, twenty two (22') feet six (6") inches above the ground, were not provided with an access ladder, thereby exposing the employees to falls.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about December 7, 2011, at the above addressed jobsite, on the north section of the 7:12 pitched roof, employees conducting roofing operations, approximately twenty-four (24') feet above the ground, were not protected from falls, thereby exposing employees to hazards associated with falls.
