29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a) In lieu of conventional fall protection the employer did not utilize an alternative fall protection plan nor comply with Appendix E, Subpart M fall protection while engaged in residential access adjacent to unprotected wall / window openings, performing unprotected roof sheeting and gutter baord erection activities exposing employees tfall potentials up to 19' in that:    1) Unprotected roof sheeting activities were observed.    2) Unprotected gutter board erection activities were observed on perimeter exterior stud wall top plates.    3) Employee(s) were observed accessing adjacent to unprotected window / wall openings.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:      a) Located along various areas of the residential structure employees were observed accessing adjacent to unprotected wall / window openings, performing unprotected roof sheeting and gutter board instillation activities in elevated positions above 13 feet without conventional fall protection or following a fall protection plan who were not trained or knowledgeable of the procedures or regulations to be followed to minimize those hazards.
