29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) West side of structure at the south end, 2nd level; On or about December 7, 2011 and at times prior thereto, an employee was prepping for the installation of a prefabricated exterior wall panel by installing adhesive via a caulking gun at the floor deck edge without a means of fall protection. b) West side of structure, 2nd level; On or about December 7, 2011 and at times prior thereto, two employees carried a completed section of a framed interior wall from one end of the deck to the other without a means of fall protection. c) West side of structure, 2nd level; On or about December 7, 2011 and at times prior thereto, three employees assisting with the installation of a prefabricated exterior wall panel being hoisted by a crane without a means of fall protection. Note: Abatement certification or documentation are NOT required for this item.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: a) West side of the 2nd level deck; On or about December 7, 2011 and at times prior thereto, an employee performing faming work including assisting with the placement of prefabricated wall panels via a crane was not wearing a hard hat. Note: Abatement certification is NOT required for this item.
