29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) On or about 21 December 2011, the employer did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling of containers of hazardous chemicals;  2) Material safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.    The employer did not develop a written hazard communication program.  Welder(s) were exposed to hazardous chemicals including but not limited to Mild Steel welding fumes from Radnor Thoriated Tungsten electrodes (contains Tungsten and Thorium Oxide); Unibraze 100S-1 Welding Wire (contains Carbon, Manganese, Molybdenum, Silicon, Nickel, and Chrome) while engaged in welding activities.  Assembly line operator(s) were exposed to hazardous chemicals including but not limited to Sherwin Williams MIL-81772B Type II Ordnance Epoxy Reducer/Thinner (contains 1-Methoxy-2-propanol; Methyl Ethyl Ketone; Methyl Isobutyl Ketone); and Sandstrom Products Co. 28A-Solid Film Lubricant (contains 1,3-dioxilane; propylene glycol methyl ether acetate; 2-propoxypropanol; molybdenum disulfide; epichlorohydrin/bisphenol A polymer; acetone).    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) On or about 21 December 2011, the employer did not provide employees with training regarding the hazards of the chemicals present in the work area.  Welder(s) were not trained on the hazardous chemicals present at their workstations including but not limited to fumes generated when welding Mild Steel hardware; Radnor Thoriated Tungsten electrodes (contains Tungsten and Thorium Oxide) and Unibraze 100S-1 Welding Wire (contains Carbon, Manganese, Molybdenum, Silicon, Nickel, and Chrome). 29 CFR 1910.1200(f)(5)(i):     The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:    (a) On or about 21 December 2011, the employer did not ensure that in the assembly area, each container of Sherwin Williams Type II Ordnance Epoxy Reducer/ Thinner (contains Methyl Ethyl Ketone and Methyl Isobutyl Ketone) and Sunnen MB 30-55 Honing Oil (contains petroleum distillates) were  labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein.  Assembly area employee(s) applied touch-up paint and honing oil to implements during the assembly of machine gun tripods.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(f)(5)(ii):     The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:    (a) On or about 21 December 2011, the employer did not ensure that in the assembly area, each container of Sherwin Williams Type II Ordnance Epoxy Reducer/ Thinner (contains Methyl Ethyl Ketone and Methyl Isobutyl Ketone) and Sunnen MB 30-55 Honing Oil (contains petroleum distillates) were  labeled, tagged or marked with appropriate hazard warnings, words, pictures, symbols or a combination thereof, which provided at least general information regarding the physical and health hazards of the hazardous chemical(s) contained therein.  Assembly area employee(s) applied touch-up paint and honing oil to implements during the assembly of machine gun tripods.
