29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) On or about December 9, 2011 and at times prior, employees were not protected from head injuries from old shingles or debris being tossed from the roof area onto the ground and/or into the truck bed and where no head protection was in use.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure:    a) On or about December 9, 2011, employees were exposed to fall hazards in excess of 12 feet, while removing the old roof material and while installing the new roofing without fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access:    a)  On or about December 9, 2011 and at times prior, employees using a portable ladder to access the roof area were exposed to fall injury in that the ladder was not secured in place nor did the side rails of the ladder extend at least 3 feet above the upper landing surface.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machine or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a)  On or about December 9, 2011 and at times prior, employees using hand tools and/or a pneumatic nail gun while re-roofing a roof were not wearing adequate eye protection that meet the requirements of ANSI Z87.1  Employees were wearing sunglasses not safety glasses.
